Alabama is a “mixed” state, meaning that you can file for divorce using either “fault” or “no fault” grounds. In other words, you can allege wrongdoing on the part of your spouse in order to gain some kind of advantage — say, for example, a child custody dispute — or you can simply state that the marriage has suffered irreparable harm without assigning blame to either party. The only hard and fast requirement is that either you or your spouse must be a resident of the state of Alabama for at least six months (180 days) before filing for divorce.

More than anything, Alabama judges want to support custody arrangements that are stable, equal and easy on the child.
