Alabama is a “mixed” state, meaning that you can file for divorce using either “fault” or “no fault” grounds. In other words, you can allege wrongdoing on the part of your spouse in order to gain some kind of advantage — say, for example, a child custody dispute — or you can simply state that the marriage has suffered irreparable harm without assigning blame to either party. The only hard and fast requirement is that either you or your spouse must be a resident of the state of Alabama for at least six months (180 days) before filing for divorce.
As is true throughout the United States, family law judges in the state of Alabama will begin a child custody hearing with the presumption that it’s in your child’s best interests to have frequent, continual contact with both you and your former spouse. More than anything, Alabama judges want to support custody arrangements that are stable, equal and easy on the child. This isn’t always possible, though, which is why it is highly recommended that you consult an experienced child custody attorney before moving forward.
